I'm wondering if there are any commercial jars among the jars needed for hibernate ?

Are we also sure that the jar needed when using hibernate outside app server and the others are released under LGPL like c3p0, jta, ehcache, odmg, cglib, jdbc2...

?

Please read the license text files in the lib/ directory of Hibernate. The ODMG license is "unknown", as the ODMG simply vanished from earth, hence it will be removed in the next Hibernate version.
