 Post subject: merge() for transient entity

According to the JPA spec, merge() should behave as persist(), for a transient entity. It should attatch the entity to the persistence context, however when I do this I get:

org.hibernate.AssertionFailure: dirty, but no dirty properties

any ideas what this means?
