why this query can't filter those deleted items in child list?

String query4 = "select distinct c.docList from data.Case as c inner join c.docList doc where c.caseId = :caseId and doc.status = :status ";
String[] args4 = new String[] { "caseId" , "status"};
Object[] vals4 = new Object[] { "12345", "active" };
List docuList = this.getHibernateTemplate().findByNamedParam(query4, args4, vals4);
